4. Financial Terms & Conditions
4.1 Financial Responsibility
Payment for services rendered is the responsibility of the patient, parent, or guardian. As a courtesy, we will verify your insurance coverage on your behalf. However, you are ultimately responsible for payment of your bill, regardless of insurance coverage. Any balance remaining after insurance claim processing will be billed to the patient.
If insurance issues arise, it is the responsibility of the patient to contact their insurance company, group plan, or employer representative for resolution. Proactive Minds is not a party to the contract between you and your insurance carrier.
4.2 Referrals & Authorizations
It is the responsibility of the patient to obtain any necessary authorization or referral required by their insurance carrier prior to receiving treatment. If a patient is treated without the proper referral or authorization, the patient assumes full responsibility for payment of all fees at the time of service.
4.3 Appointment & Cancellation Policy
Cancellation Fee: A $50 cancellation fee will be charged for cancellations made within 24 hours of a scheduled appointment or for missed appointments (no-shows).
Tardiness: Arriving more than 10 minutes late will be treated as a no-show, and the same fee will apply.
Termination Policy: More than three consecutive cancellations or no-shows within a calendar year may result in a termination letter. You are welcome to resume care once you are able to commit to your scheduled appointments.
5. Telehealth Services
5.1 What is Telehealth
Tele-psychiatry and Tele-therapy involve the delivery of psychiatric or therapeutic services using interactive audio and video technology between a provider and patient who are not in the same physical location. These systems use security protocols to protect the confidentiality of patient information.
5.2 Potential Benefits
Increased accessibility to psychiatric and mental health care.
Greater convenience and flexibility for patients.
5.3 Potential Risks
Poor video or audio quality may limit the provider's ability to make clinical decisions.
Technical failures may cause delays in evaluation or treatment.
Security breaches could result in unauthorized access to confidential health information.
Information available in a face-to-face visit may not always be accessible in a telehealth session.
5.4 Patient Rights & Responsibilities
You have the right to withdraw consent to telehealth services at any time without affecting your future care.
You have the right to access and obtain copies of all records related to your telehealth visits.
You will not record any telehealth session without written consent from your provider.
You are responsible for ensuring your device and internet connection are functioning properly before each session.
If you are in a life-threatening emergency, please call 9-1-1 or go to the nearest emergency room immediately.
6. Confidentiality & Consent for Treatment
All information shared with Proactive Minds is confidential and will not be disclosed without your consent, except as required by law. Limited exceptions include:
When there is an imminent risk of harm to you or another person.
When there is reasonable suspicion of child or elder abuse or neglect.When a valid court order requires disclosure of medical records.
You understand that while therapy and/or medication may provide significant benefits, they may also involve risks such as uncomfortable emotions, recall of difficult memories, or medication side effects. You are encouraged to discuss any concerns with your provider at any time.
By engaging our services, you consent to assessment and treatment by Proactive Minds and understand that you may stop treatment at any time.
7. Limitation of Liability
To the fullest extent permitted by law, Proactive Minds and its staff, officers, and representatives shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services or website. You accept full responsibility for your own use of the services
Nothing in these Terms limits our liability for fraud, personal injury, or any other liability that cannot be excluded under applicable law.
